Our objective is to assist users in identifying potential inaccuracies, inconsistencies, and other deficiencies prior to their official submission to the relevant government authorities.
The Services include, but are not limited to:
An automated analysis of your visa application forms and supporting documents. The generation of a detailed report ("Report") highlighting potential errors, areas of concern, and omissions. Suggestions for rectifying identified issues, based on publicly available visa adjudication standards and best practices. Our AI system is designed to simulate the review process based on criteria and guidelines commonly used by consular and immigration officials. By doing so, we aim to assist our Users in maximizing the clarity, completeness, and accuracy of their application materials, thereby potentially enhancing their prospects for a successful visa application outcome.
3.1. Nature of AI-Powered Assistance: You expressly understand and acknowledge that the core of our Services is an AI-powered software tool. As with any AI system, its output is based on algorithms and data analysis and is probabilistic in nature. The suggestions and Reports provided by our Services are for informational purposes only and are intended to serve as a guide to assist you in preparing your visa application.
3.2. No Legal Advice or Representation: Miss Visa is not a law firm, nor is it a substitute for the advice of a qualified immigration attorney or accredited visa consultant. The use of our Services does not create an attorney-client relationship. Our Services provide a technological analysis of submitted data and do not constitute legal advice, legal opinion, or legal representation. We do not review your materials for legal sufficiency, draw legal conclusions, or apply the law to the facts of your particular situation. You are solely responsible for your own choices and actions based on the information provided by our Services.
3.3. No Guarantee of Outcome or Accuracy: The final decision on any visa application rests exclusively with the designated government agency and its adjudicating officers. The visa adjudication process is discretionary and subject to numerous factors beyond our control or knowledge, including, but not limited to, changes in immigration law and policy, the individual judgment of the reviewing officer, and information not provided to us.
Therefore, Miss Visa makes no representation, warranty, or guarantee, express or implied, as to the ultimate outcome of your visa application. While we strive for the highest degree of accuracy and alignment with the known standards of consular officials, we do not warrant that our Services are infallible or that the use of our Services will result in the approval of your visa application or prevent a request for further information.
3.4. User's Ultimate Responsibility: You retain the sole and ultimate responsibility for the accuracy, completeness, and timely submission of your visa application. The Report and suggestions we provide are intended to be a tool for your use, not a final, ready-to-submit document. It is incumbent upon you to independently verify all information and ensure your application package is correct and complete before submission.
To provide and improve our Services, we require you to upload digital copies of your visa application materials, including personal information and supporting documents ("User Content"). By uploading your User Content, you grant Miss Visa a worldwide, non-exclusive, royalty-free, perpetual, irrevocable, and transferable license to use, reproduce, modify, adapt, analyze, process, and create derivative works from your User Content.
This license is granted for the following specific purposes:
To provide the Services to you, including generating your personalized Report. To train, enhance, and improve our AI models, algorithms, and the overall functionality and performance of our Services. To conduct internal research and data analysis to understand trends and improve service quality. For the purpose of improving our systems as described in this section, your User Content will be anonymized or aggregated to the extent reasonably possible to protect your privacy. We will not use your personally identifiable information for marketing or sell it to third parties. For more detailed information on how we collect, use, and protect your personal data, please review our Privacy Policy, which is incorporated by reference into these Terms.
By using the Site and our Services, you represent and warrant that:
All information you submit to us is true, accurate, current, and complete. You have the legal right to possess and upload the User Content you provide. Other than your User Content, the Site and its entire contents, features, and functionality (including but not limited to all information, software, AI models, text, displays, images, video, and audio, and the design, selection, and arrangement thereof) are owned by Miss Visa, its licensors, or other providers of such material and are protected by international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws. You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Services for your personal, non-commercial use only, strictly in accordance with these Terms.
TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT WILL MISS VISA, ITS DIRECTORS, EMPLOYEES, AFFILIATES, OR AGENTS BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY DIRECT, INDIRECT, CONSEQUENTIAL, EXEMPLARY, INCIDENTAL, SPECIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFIT, LOST REVENUE, LOSS OF DATA, OR OTHER DAMAGES ARISING FROM YOUR USE OF THE SITE OR THE SERVICES, OR FROM YOUR RELIANCE ON ANY INFORMATION OR REPORT PROVIDED BY THE SERVICES, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
NOTWITHSTANDING ANYTHING TO THE CONTRARY CONTAINED HEREIN, OUR LIABILITY TO YOU FOR ANY CAUSE WHATSOEVER AND REGARDLESS OF THE FORM OF THE ACTION, WILL AT ALL TIMES BE LIMITED TO THE AMOUNT PAID, IF ANY, BY YOU TO US FOR THE SERVICES DURING THE SIX (6) MONTH PERIOD PRIOR TO ANY CAUSE OF ACTION ARISING.
You agree to defend, indemnify, and hold us harmless, including our subsidiaries, affiliates, and all of our respective officers, agents, partners, and employees, from and against any loss, damage, liability, claim, or demand, including reasonable attorneys’ fees and expenses, made by any third party due to or arising out of: (1) your User Content; (2) your use of the Services; (3) your breach of these Terms and Conditions; or (4) your violation of the rights of a third party, including but not limited to intellectual property rights.
These Terms and Conditions shall remain in full force and effect while you use the Site or Services.
